Export control and compliance
Responsible access to AI infrastructure
Eleveight AI currently runs an AI factory in Gagarin, Armenia, built on NVIDIA Blackwell B300 GPUs and other U.S.-origin technology, so compliance, security and responsible access shape how we operate and how we decide who uses our infrastructure.
We are committed to conducting our business in accordance with applicable U.S. export control laws, including the Export Administration Regulations (EAR) administered by the U.S. Department of Commerce’s Bureau of Industry and Security (BIS), U.S. sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC), and the other laws and regulations that apply to our operations.
The NVIDIA hardware in our AI factory remains subject to the EAR wherever it operates, and we review every customer’s access to it on that basis.
These obligations extend beyond our own operations to our customers, our partners and the end users of our infrastructure, which is why every request for capacity goes through the review described below.
Customer eligibility and compliance requirements
Access to our GPU infrastructure is subject to applicable regulatory requirements, internal compliance review and customer eligibility verification. To qualify for access, customers may be required to:
- Complete customer due diligence. Provide accurate information regarding their legal identity, where they and their ultimate parent company are headquartered, ownership and control structure, ultimate beneficial owners, business activities and relevant end users.
- Disclose intended use. Provide sufficient information regarding the intended application of computing resources, including any AI model training, relevant end users, and the countries or territories from which the infrastructure will be accessed or administered.
- Comply with export controls and sanctions. Confirm in writing that their proposed activities comply with applicable U.S. export control and sanctions requirements and other relevant regulations, and renew that confirmation when we ask.
- Prevent unauthorized access and diversion. Ensure that computing resources are not made available, directly or indirectly, to prohibited or unauthorized persons, entities, destinations or end uses, including through resale, subcontracting or other third-party arrangements, and refrain from using VPNs, proxies or other means to hide where the infrastructure is accessed from.
- Support ongoing compliance. Promptly notify Eleveight AI of material changes to ownership, control, end users, intended applications or other circumstances relevant to compliance, and cooperate with reasonable verification requests.
- Apply the same rules downstream. Make sure their own users, contractors and affiliates meet these requirements too.
Restricted and prohibited activities
We do not knowingly provide access to our computing infrastructure where doing so would violate applicable export controls, sanctions or other legal restrictions.
Access may be restricted or denied where proposed activities involve prohibited end users, unauthorized destinations, restricted military or intelligence applications, unlawful diversion or other activities inconsistent with applicable regulatory requirements. We screen customers, their owners and other relevant parties against U.S. government restricted party lists, including the Entity List and the Specially Designated Nationals and Blocked Persons List, and treat companies owned or controlled by listed parties the same way.
Prohibited end uses include weapons of mass destruction, restricted military and military-intelligence end uses, and training AI models for or on behalf of parties headquartered in Country Group D:5 countries or Macau, unless any required U.S. authorization is in place.
Compliance review and access authorization
All requests for computing capacity are subject to applicable compliance review and commercial approval.
We may request additional documentation, conduct enhanced due diligence, decline or suspend services, or terminate access where required by law, applicable authorization conditions, or our compliance requirements and contractual terms.
Completing onboarding does not guarantee an allocation of capacity. Capacity shown as available on our website or platform is not reserved for, or promised to, any particular customer until the compliance review and commercial approval are complete and an agreement is in place.
If we find signs of possible diversion or a breach of these requirements, we investigate, suspend access where needed and report to the relevant authorities where the law requires it. We also cooperate with verification and end-use checks requested by U.S. authorities.
Our ongoing commitment
We maintain a risk-based compliance framework suited to our infrastructure, our customers and our operations, and we update it, together with this page, as U.S. export control rules change.
For us, building AI infrastructure responsibly means being transparent about how access is granted and accountable for how it is used, in line with applicable regulatory standards. Physical access to our AI factory is restricted to authorized personnel and recorded.
